These Terms of Use govern your access to and use of Charmly, including the mobile app, keyboard functionality, website, and related API services. By using Charmly, you agree to these terms.
Eligibility
You must be at least 18 years old to use Charmly.
The Service
Charmly provides AI-assisted message suggestions, including suggestions generated from screenshots and user-selected messaging preferences. The service is intended to help with drafting and inspiration only.
Your Responsibilities
You agree to:
- use Charmly only for lawful purposes;
- submit only content you have the right to use and share with us for processing;
- avoid using the service to harass, deceive, abuse, impersonate, or violate another person's rights;
- comply with the terms and rules of third-party platforms where you use generated suggestions.
You are responsible for the screenshots, messages, prompts, and other content you submit.
AI Output Disclaimer
Charmly generates suggestions automatically using third-party AI systems. We do not guarantee that outputs will be accurate, appropriate, effective, available, or suitable for any specific situation. You are solely responsible for reviewing and deciding whether to use any generated reply.
Permissions and Device Features
Certain features may require device permissions, such as photo library access for screenshot-based suggestions. If you deny required permissions, some features may be limited or unavailable.
Subscriptions and Paid Features
Some features require an active paid subscription. Subscription purchases, billing, renewals, cancellations, refunds, and related payment terms are generally handled by the applicable app marketplace and supporting subscription infrastructure. Access to premium features may be limited, suspended, or removed if your subscription is inactive, canceled, expired, refunded, or revoked.
Acceptable Use Restrictions
You may not:
- reverse engineer, copy, resell, scrape, or exploit the service except as allowed by law;
- interfere with the security, stability, or operation of the app, website, API, or related systems;
- attempt to bypass authentication, subscription checks, rate limits, or access restrictions;
- use the service in a way that could expose us or others to legal liability.
Third-Party Services
Charmly relies on third-party providers, including providers for analytics, AI processing, and subscription verification. We are not responsible for outages, policy changes, or acts of third-party platforms or services.
Intellectual Property
Charmly, including its software, branding, design, and related content, is owned by us or our licensors and is protected by applicable intellectual property laws. These terms grant you a limited, non-exclusive, revocable right to use the service for personal, non-commercial use in accordance with these terms.
Suspension and Termination
We may suspend or terminate your access, with or without notice, if we believe you violated these terms, created risk for the service or other users, or if suspension is required for legal, security, or operational reasons.
Disclaimer of Warranties
Charmly is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of Liability
To the maximum extent permitted by law, Charmly and its affiliates, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, goodwill, or business opportunities arising from or related to your use of the service.
Changes to the Service or Terms
We may modify, suspend, or discontinue any part of the service at any time. We may also update these Terms of Use from time to time. If we do, we will post the updated version here. Your continued use after changes take effect means you accept the revised terms.
